| Arizona Supreme Court Blocks Key Evidence in Botched Abortion Case By Rusty Pugh (AgapePress) - The Arizona Supreme Court has stopped prosecutors from using three strong pieces of evidence in the manslaughter trial of an abortion practitioner and abortion facility manager accused of botching a legal abortion that killed a young woman. Without comment, the justices last week refused to allow jurors to be told about prior disciplinary actions taken by the Arizona Board of Medical Examiners against abortion practitioner John Biskind for medical malpractice. Those records showed, among other things, that Biskind had mis-diagnosed the term of another patient’s pregnancy and had failed to follow up her treatment after an attempted abortion that failed. Whether prosecutors will be able to obtain a conviction now is in doubt. Bill Fitzgerald, spokesman for the Maricopa County Attorney’s office, said his agency intends to pursue the criminal charges against both Biskind and Carol Stuart-Schadoff. Both are charged with manslaughter in connection with the 1998 death of Lou Anne Herron, who had gone to their abortion facility to have an abortion. Herron was left to bleed to death in the recovery room after her uterus was ruptured during the gruesome abortion. © 2001 AgapePress all rights reserved.
